Terms and Conditions
1. SCOPE
The general terms and conditions of the Caribic-Home agency, Unterdorfstrasse 1, 6044 Udligenswil, apply to all services provided through the Caribic-Home agency and to all contracts concluded with Caribic-Home. These terms and conditions apply exclusively even if Caribic-Home provides its services without reservation after becoming aware of deviating provisions or general terms and conditions. Caribic-Home reserves the right to make changes to these terms and conditions at any time. The currently valid version of the terms and conditions will be published at www.caribichome.com and is deemed accepted by the customer upon publication.
2. OFFER AND CONCLUSION OF CONTRACT
The service offer is aimed exclusively at customers residing in Switzerland, Liechtenstein, Germany, Austria, and Italy. All information about the offer is non-binding for Caribic-Home and does not constitute an offer in the legal sense. Caribic-Home expressly reserves the right to make changes to offers, services, and prices at any time. Images of offers, services, and advertisements in the online shop are for illustrative purposes only and are not binding for Caribic-Home.
By submitting the service request during the online shop ordering process, the customer submits a binding offer that cannot be changed. Upon receipt of the customer's service order via the online shop, Caribic-Home will automatically send the customer an order confirmation with an order number via email. This order confirmation via email does not constitute acceptance of the customer's binding offer, and no contract is concluded. A contract is only concluded upon provision of the service to the customer.
Caribic-Home reserves the right to refuse the service, in whole or in part, without giving reasons until the service is provided to the customer. In this case, the customer will be informed immediately.
Prices in the online shop are in Swiss Francs and do not include VAT. Caribic-Home is not subject to VAT. The applicable price at the time of the order applies, plus any additional services. The minimum age for ordering in the online shop is 18 years.
3. DATA PROTECTION
The protection of customer data is very important to us. We collect and process data using high-quality processing systems in compliance with applicable Swiss data protection law. Your data will be used exclusively to process your order and to improve our product range and services. Shop Kunstarbeit will treat your data confidentially and will not share it with third parties. 4. LIABILITY
Caribic-Home excludes liability, to the extent permitted by law, for all direct and indirect damages arising from the use of the online shop/service or in the context of ordering services or concluding contracts via the online shop. In particular, Caribic-Home excludes all liability for slight and moderate negligence. Caribic-Home also assumes no contractual or non-contractual liability for damages caused by companies engaged to provide services.
5. APPLICABLE LAW AND JURISDICTION
All legal relationships between customers and Caribic-Home are governed by Swiss law. The place of jurisdiction for disputes arising from or in connection with the legal relationships between Caribic-Home and the customer is Lucerne or the consumer's place of residence. Otherwise, the courts of Lucerne have exclusive jurisdiction for disputes arising from or in connection with legal relationships between Shop Kunstarbeit and the customer.
6. SEVERABILITY CLAUSE
Should individual provisions of the General Terms and Conditions be or become invalid or ineffective, or should the General Terms and Conditions contain an unforeseen gap, the validity of the remaining provisions and the General Terms and Conditions as a whole shall remain unaffected.
